About this website

The website describes the Company, its services and the platforms it builds and implements. Its content is general information. It is not professional advice and it is not an offer to provide services; any proposal or price we give you is valid only when confirmed in writing.

Any project, licence or support engagement is governed by a separate written agreement between you and the Company. If that agreement and these terms differ, the agreement prevails.

Intellectual property

The text, design, graphics, photographs, software code, the Knowledge Discovery name and the KD logo are owned by or licensed to the Company and are protected by the Copyright Act B.E. 2537 (1994), the Trademark Act B.E. 2534 (1991) and international treaties.

You may view and print pages for your own reference or for internal evaluation within your organisation, provided you keep any copyright notices. You may not copy, modify, republish, frame or distribute the content for commercial purposes, or use our name or logo, without the Company’s written permission.

Names and marks of third-party products and organisations mentioned on the website belong to their respective owners, and mentioning them does not imply endorsement.

Acceptable use

When you use the website, you agree not to:

• use it in any way that breaks Thai law, including the Computer Crime Act B.E. 2550 (2007) as amended, or the law of the place where you are;
• attempt to gain unauthorised access to the website, its servers or any connected system, or bypass its security measures;
• interfere with its operation, overload it, or introduce viruses or other malicious code;
• collect content or contact details from it by automated means for bulk use or unsolicited marketing;
• submit false information or impersonate the Company or any other person.

If you find a security vulnerability in the website, please report it to us by email and give us reasonable time to fix it before disclosing it to anyone else. Please do not access or change data that is not yours while testing.

Information you send us

When you contact us through the website, please give accurate information. Please do not send confidential information, or sensitive personal data such as health or religious information, until a confidentiality agreement is in place between you and the Company.

Ideas or suggestions you send us without a written agreement are not treated as confidential, and we have no obligation to you if we develop something similar independently.

Links to other websites

The website may link to websites and services run by others, such as maps or partner products. The Company does not control them and is not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

Availability and accuracy

We work to keep the website accurate, secure and available, but to the extent permitted by law it is provided “as is” and “as available”. We may change, suspend or withdraw any part of it at any time, and we do not guarantee that it will be error-free, uninterrupted or free of harmful components.

Limitation of liability

To the extent permitted by law, the Company is not liable for any indirect or consequential loss, or for loss of profit, data or business, arising from your use of, or inability to use, the website or reliance on its content. The website is provided free of charge, and its content is not a substitute for advice under a written agreement.

Nothing in these terms excludes or limits liability for death or bodily injury caused by negligence, for fraud, wilful misconduct or gross negligence, or any other liability that cannot be excluded or limited under Thai law, including the Unfair Contract Terms Act B.E. 2540 (1997), or under the mandatory consumer laws of the country where you live.

Electronic communications

You agree that information, notices and messages we exchange electronically, such as by email, satisfy any requirement for them to be in writing, in accordance with the Electronic Transactions Act B.E. 2544 (2001).

We may update these terms from time to time, for example to reflect changes in the law or in the website. The current version is always on this page, with the date it was last updated. Changes apply from that date and do not apply to your use of the website before it; continuing to use the website after a change means you accept the updated terms.

• If any part of these terms is found invalid or unenforceable, the rest remains in effect, and the affected part applies to the fullest extent the law allows.
• If we do not enforce a right under these terms straight away, we do not give up that right.
• These terms are published in Thai and English, and both versions are intended to have the same meaning. If they conflict, the Thai version prevails.

Governing law and disputes

These terms are governed by the laws of the Kingdom of Thailand. We encourage you to contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved this way is subject to the jurisdiction of the courts of Thailand. If you are a consumer, this does not take away any protection given to you by the mandatory laws of the country where you live.
